Terms of service

These Terms of Service apply to your use of atakicollections.com and to any purchase from Ataki Collections ("we", "us", "our"), #1450, Polegoda, Mahagama, Kalutara, Sri Lanka. By using our website or placing an order, you agree to these terms. Please also read our Shipping policy, Refund policy and Privacy policy, which form part of these terms.

1. Using our store

  • You must be at least 18, or have permission from a parent or guardian, to place an order.
  • You agree to give accurate contact, delivery and payment details.
  • You must not misuse the website, for example by attempting to gain unauthorised access, interfering with its operation, or placing fraudulent orders.

2. Products and descriptions

  • We try to show colours, prints and details as accurately as possible. Screens differ, so colours may look slightly different in person, and printed fabrics may vary slightly from piece to piece.
  • Measurements in our Size guide are a guide only. Fit varies by style and fabric.
  • All products are subject to availability. We may limit quantities or discontinue items at any time.

3. Prices and payment

  • Prices are shown in Sri Lankan Rupees (LKR) for Sri Lanka and in Canadian Dollars (CAD) for Canada. Prices for Canada are set separately and are not a direct currency conversion of Sri Lankan prices.
  • Delivery fees are shown at checkout before you pay.
  • For Canadian orders, import duties, taxes and brokerage fees charged on arrival are the recipient's responsibility.
  • We accept the payment methods shown at checkout. Cash on Delivery is available within Sri Lanka only, and COD orders may be confirmed by phone before dispatch.
  • If a product is listed at an incorrect price because of an error, we may cancel the order and refund any amount paid, even after confirmation.

4. Orders

  • Your order is an offer to buy. A contract is formed when we dispatch your order.
  • We may refuse or cancel an order, for example if an item is out of stock, we suspect fraud, we cannot verify a COD order, or delivery is not possible to your address. If you have already paid, we'll refund you in full.
  • Repeatedly refusing Cash on Delivery parcels may result in COD being unavailable for future orders.

5. Delivery, exchanges and returns

Delivery times, costs and free-delivery thresholds are set out in our Shipping policy. Exchanges, returns and refunds are covered by our Refund policy. Nothing in these terms limits your statutory rights as a consumer.

6. Discount codes and promotions

Discount codes and promotions are subject to their stated conditions, cannot be exchanged for cash, and may be withdrawn at any time. Only one discount code can be used per order unless stated otherwise.

7. Intellectual property

All content on this website, including photos, text, graphics and the Ataki Collections name and logo, belongs to us or our licensors. You may not copy or use it for commercial purposes without our written permission.

8. Customer accounts

You are responsible for keeping your account login secure and for activity under your account. Tell us straight away if you think your account has been used without permission.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the website or our products. Our total liability for any order is limited to the amount you paid for that order. Nothing in these terms excludes liability that cannot be excluded under Sri Lankan law, including the Consumer Affairs Authority Act No. 9 of 2003.

10. Third-party services

Our website uses third-party services such as Shopify, payment providers and couriers. Their own terms and privacy policies also apply to the services they provide.

11. Changes to these terms

We may update these terms from time to time. The version on this page at the time of your order applies to that order.

12. Governing law

These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute.
